Terms of Service | Focus Shots

1. Cooperation

1.1 The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment.

2. Booking

2.1 Acceptance of the Quote in writing via email by the client is required to secure a booking for a specified service. Focus Shots Corporate Photography does not charge a booking fee to secure a booking for a specified service.

3. Payment of Tax Invoice

3.1 We request that the Tax Invoice be paid in full prior to receiving the finished retouched photos. The Tax Invoice will be issued to the client via email on the day of the shoot. The Tax Invoice is payable within 7 days from receipt.

4. Cancellation and Rescheduling Policy

4.1 If the client must cancel or reschedule, Focus Shots Corporate Photography must be notified at least 24-hours prior to the session date to qualify for a reschedule. The reschedule date will be made as soon as possible, at the photographer’s discretion. Focus Shots Corporate Photography does not charge a cancellation or rescheduling fee.

5. Copyrights

5.1 The photographs produced by Focus Shots Corporate Photography are protected by Australian Copyright Act 1968 (all rights reserved) and may not be reproduced in any manner without Focus Shots Corporate Photography’s explicit written permission. Upon image distribution or images purchased from Focus Shots Corporate Photography, limited copyright ownership of the resulting images will be transferred to client under the following conditions:

The photographic images are the property of the client for personal use and for the purpose of reproduction and giving photographs to friends, relatives and to promote their business via social media and business cards.
The client must obtain written permission from, and compensate Focus Shots Corporate Photography, prior to the client or client’s friends and relatives publishing or selling the photographs for profit.

6. Exhibition

6.1 Requests for photographic images to be used by Focus Shots Corporate Photography may be requested at a future time. The client grants Focus Shots Corporate Photography permission to display selected images resulting from this assignment as an example of Focus Shots Corporate Photography’s work and for entrance into photographic competitions and release all claims to profits that may arise from use of images.

6.2 If the client's photo is requested to be used in any print or online publication, they will discuss this with Focus Shots Corporate Photography. Focus Shots Corporate Photography grants the client limited rights to use the images in marketing materials with specifications that photos produced by Focus Shots Corporate Photography be attributed accordingly and listed on the image/article. If the client requests to use the image in the distribution of products such as but are not limited to posters, clothing, etc., a 30% compensation rate of the total number of sales will apply unless otherwise agreed upon in writing.

7. Model Release

7.1 The client hereby grants Focus Shots Corporate Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. Then hereby releases Focus Shots Corporate Photography and its legal representatives and assigns from all claims and liability relation to said photographs.

8. Limit of Liability

8.1 Focus Shots Corporate Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Focus Shots Corporate Photography’s control, Focus Shots Corporate Photography’s liability is limited to the return of all payments received for the event/session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

9. Retouching Policy

9.1 Focus Shots Corporate Photography provides the following photo retouching service to all session packages as standard, to include:

Adjusting overall contrast and saturation
Backdrop application
Removing red eyes
Sharpening and finishing

9.2 In the event that the client requests retouching and extensive editing beyond the above listed standard photo retouching service, editing can be provided for an additional fee per image to be paid prior to any requested editing being completed.

10. Equipment

10.1 Focus Shots Corporate Photography’s mobile photographers will come to you, whether at the workplace or at your home, with all the equipment needed to take your professional pictures, including backdrop and lighting. It is the photographers discretion to which equipment is best suited to particular spaces and lighting conditions.

10.2 The photographer will request a private well-lit space space/room for the photos to be taken. The photographer will take 15-20 minutes approximately, depending on the session package, to set up the equipment and test lighting that is included within the session time/package.

10.3 When organising a team please provide a list of team members to tick off, in order to minimise disruptions and time wastage. When catering to large groups for team/group shoots it may be necessary for the photograph to be taken outdoors, which will be finalised before the shoot.

11. Weather Policy

11.1 In the event of weather conditions out of our control due to photography equipment and lighting conditions/ limitations, it is the photographer’s discretion if the session will be cancelled. If such an event occurs, the client will be given the opportunity to reschedule for the next available date. If the client pursues the session, regardless of the photographer’s advice, and the images are not up to Focus Shots Corporate Photography standards, the client will be responsible for all charges related to scheduling an additional shoot.

12. Props & Outfits

12.1 The client is responsible for bringing any props and outfits that they would like in their photos. In the event that the client has forgotten a prop or outfits for the session and wants photos with that prop and outfits, the client will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.

13. Appearance

13.1 In the event that the client would like additional photos due to appearance out of the photographer’s control (hair/makeup, etc.) in the previous session, the client will be charged for an additional session at the photographer’s session rate to reschedule or shoot additional photos.

14. Locations

14.1 Focus Shots Corporate Photography services business individuals located within the Melbourne & Sydney CBD and inner suburbs within 20km. Focus Shots Corporate Photography does not charge a call-out fee. Travel costs are included within the session package.

14.2 If the client wishes to include multiple locations in addition to the quoted offer, there will be a fee of $100 per additional location change within the Melbourne metropolitan area. Focus Shots Corporate Photography will be notified in advance of all the locations, directions, and addresses. Note that the additional travel time incurred will be included in the total session time.

15. Tolls, Location Access and Fees

15.1 If the client chooses a location outside of our serviceable area, and the photographer requires Toll road access, the client is responsible to cover those fees associated with shooting at remote locations.

15.2 If the client chooses a location which charges admission, an access fee, a parking fee, or a photography fee, the client will be responsible to cover those fees associated with shooting at those locations. The client will also be responsible for organising the access and any permits related to doing so.

16. Additional Members

16.1 In the event that the client wants to add additional family/staff members in the session beyond the scope of the agreed upon quote, they will be charged at an additional cost and issued an amended or new Quote and Invoice accordingly.

17. Unpunctuality

17.1 In the event that the client is late to the appointment set, the client’s session will still be for the same scheduled ending time. The Photographer will wait at agreed upon meeting location until 15 minutes after the session start time. In the event that the client does not arrive within 15 minutes of the session time and date, the client will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.

18. Selecting Photos

18.1 Following the shoot the photographer will send the client the pre-selected unedited RAW JPEG images via email or Dropbox link for client review and selection. The client will have restricted access to view only and photos will feature a watermark, to limit image theft. Once the client has made their selection, via reply email, the photographer will commence the standard photo retouching service.

18.2 In the event the client is unhappy with the photos they may request to have them taken again. In such cases the client will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.

19. Completion Schedule

19.1 Image delivery for the final retouched images takes approximately 1 week, but may take longer. In the event that image delivery is outside of this time, the client will be notified via email before the due date.

20. Receiving photos

20.1 Output will be in the form of JPEG images and will be sent via email or Dropbox link for the client to download to their computer or mobile device. The Dropbox link will stay active for 1 week for the client to do so. If the client wishes to obtain copies in the future they can contact Focus Shots Corporate Photography directly.
